2. Accounts and Identity

We use a passwordless system. Your identity is tied to the email address or phone number you provide during the claim process. You are responsible for keeping access to that email or phone secure. Any action taken using the verification links or codes sent to your contact details will be considered an action taken by you.

3. Who may use WHOTOPS

You must be at least 18 years old, or the age of majority in your jurisdiction, to use our platform and pay for a listing. By placing or raising a listing, you legally confirm that:

• You have the legal capacity to enter into a binding agreement;
• The website or content you are listing belongs to you, or you have explicit permission from the owner to promote it;
• The contact and payment details you provide are accurate, current, and belong to you.

4. Listings and content rights

A listing consists of a title, a public URL, a category, and optionally a description and an image. The URL must point to a public address that functions correctly.

You are entirely responsible for the content of your listing and the website it links to. By submitting a listing, you grant WHOTOPS a worldwide, non-exclusive, royalty-free license to store, display, and promote the text, images, and brand assets you provide, for as long as your listing remains on the board. You retain all ownership rights to your intellectual property.

5. Payments and ranking

All payments are processed securely by our partner, Paystack, and are charged in Ghanaian Cedi (GHS). A new listing requires a minimum bid of GHS 5. To outbid an existing listing, you must clear a minimum increment (ranging from GHS 10 to GHS 100 depending on the current bid level).

You pay the exact amount of your bid as a one-time payment. We do not charge recurring subscriptions. Your rank is updated as soon as your payment is confirmed by our servers.

If you wish to raise the rank of an existing listing you own, you are only charged the difference between your current total and your new desired bid. If another user outbids you, your listing does not disappear; it simply moves down the board to the position dictated by your total paid amount.

6. Refunds and Chargebacks

Because you are purchasing immediate digital placement, payments are strictly non-refundable in the normal course of business. The rank you receive at the time of payment is the fulfillment of our service.

We will only issue a refund if your payment was successful but we subsequently decide to remove your listing during our moderation review, before it has had a chance to benefit from its placement. We do not issue refunds if your listing naturally falls in rank due to others bidding higher, or if you simply change your mind.

Filing a fraudulent chargeback or payment dispute for a valid transaction will result in the immediate and permanent ban of your account and all associated URLs.

7. Removal and moderation

We actively monitor the board. We reserve the right to review, reject, suspend, or permanently remove any listing that violates these terms, our Rules, or local laws, regardless of how much money was paid. We are not obligated to maintain any specific listing at #1 or any other rank; the rank is determined purely by the bidding system and compliance with our standards.

8. Prohibited Activities

You may not use WHOTOPS to do any of the following:

• Mislead our visitors, impersonate another person or business, or misrepresent the nature of your listing;
• Promote scams, phishing operations, malware, pyramid schemes, or any illegal services;
• Link to pornographic, sexually explicit, or otherwise adult content;
• Use automated bots, scripts, or scrapers to send high volumes of requests, manipulate bids, or distort view and click analytics;
• Attempt to bypass our security, probe our infrastructure, or interfere with the normal operation of the board.

9. Platform Availability

We strive to keep the board running 24/7, but we provide the service "as is" and "as available". We may experience downtime for maintenance, upgrades, or unforeseen technical issues. We do not guarantee uninterrupted access and we are not liable for any loss of visibility during downtime.

10. Intellectual Property

The code, design, logos, and written content of the WHOTOPS platform are owned by us. You may not copy, modify, or distribute our platform's assets without permission. Your listing content remains yours.

11. Limitation of Liability and Indemnification

To the maximum extent permitted by law, WHOTOPS, its founders, and its employees will not be liable for any direct, indirect, incidental, or consequential damages (including lost profits or lost data) arising from your use of the platform.

In all cases, our total maximum liability to you for any claim relating to a listing will not exceed the exact amount you paid for that specific listing. You agree to indemnify and hold us harmless from any legal claims, damages, or expenses brought by a third party because of your listing or your violation of these terms.

12. Changes to these terms

We may update these terms as our product evolves. We will indicate the "last updated" date at the top of this page. If we make major changes that significantly affect your financial rights, we will notify you via the email address on file. Continuing to use the platform after changes are published means you accept the new terms.

13. Ending this agreement

You can stop using WHOTOPS at any time. Paid listings will remain on the board until they naturally fall out of rank or are removed by us. We may terminate this agreement and ban your access without notice if you seriously or repeatedly violate these terms or the law. Terminating the agreement does not entitle you to a refund for past placements.

14. Governing Law and Disputes

These terms are governed strictly by the laws of the Republic of Ghana. If a dispute arises, we ask that you contact us first to resolve it informally. If we cannot reach an agreement, any legal proceedings must be resolved exclusively in the courts located in Ghana.
